RELEASE OF LIABILITY AND ASSUMPTION OF RISK

I (referred to as "Guest") desire to participate in a ghost tour to specified locations around the greater Gettysburg, Pennsylvania area, each paired with a drink experience (the "Activity") provided by Gettysburg Boo’s and Booze, LLC, a Pennsylvania limited liability company, with offices located at 639 S Washington St., Gettysburg, PA 17325 (the "Company"). In consideration of being permitted by the Company to participate in the Activity and in recognition of the Company's reliance hereon, I agree to all the terms and conditions set forth in this instrument (this "Release"). 1. Guest must be over 21 in order to consume alcoholic beverages during the Activity. Underage drinking will not be tolerated during this Activity. If Guest is caught consuming alcohol while under the age of 21, Guest will be removed from the activity immediately and will not be eligible for a refund. Company, or any of its representatives, reserve the right to request proof of age of anyone in possession of or consuming alcohol. 2. Guest acknowledges that Company is not providing alcohol to Guest. Guest will have the option to select either an alcoholic or non-alcoholic beverage at the pre-determined tour locations and the beverage will be provided by a licensed establishment. Guest is responsible for Guest’s own behavior. Guest is responsible for remaining in compliance with, and abiding by all relevant laws, regulations, and ordinances, including open container laws. Company reserves the right to remove anyone from the Activity who appears to be visibly intoxicated or is otherwise in breach of these rules. 3. Any food, beverage, or alcohol must be consumed prior to re-entry on to the vehicle. Guest shall be responsible for all loss or damage to Company’s property. Guest shall defend, indemnify, and hold harmless the Company against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, fees, and the costs of enforcing any right to indemnification under this Release, incurred by the Company, arising out or resulting from any claim of a third party related to Guest’s participation in the Activity, regardless of negligence or fault of Company or any manager, employee, agent. In no event shall Company be liable for any amount in excess of the ticket price paid to the Company by Guest under this Release. 4. This Release constitutes the sole and entire agreement of the Company and Guest with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the Company, or its Releasees and Guest and our respective heirs, successors, and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the Commonwealth of Pennsylvania without giving effect to any choice or conflict of law provision or rule (whether of the Commonwealth of Pennsylvania or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Adams County, Pennsylvania, and I hereby consent to the exclusive jurisdiction of such courts. 5. I hereby expressly waive and release any and all claims, now known or hereafter known, against the Company, and its manager(s), employees, agents, affiliates, successors, and assigns (collectively, "Releasees"), on account of injury, disability, death, or property damage arising out of or attributable to my participation in the Activity, whether arising out of the ordinary negligence of the Company or any Releasees or otherwise. I covenant not to make or bring any such claim against the Company or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims. This waiver and release does not extend to claims for gross negligence, willful misconduct, or any other liabilities that Pennsylvania law does not permit to be released by agreement. 6. I hereby consent to receive medical treatment deemed necessary if medical attention is required during participation in the Activity. Guest understands and agrees that Guest am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. Guest hereby releases, forever discharges, and holds harmless the Company, and the Releasee’s from any claim based on such treatment or other medical services. 7. I AM AWARE AND UNDERSTAND THAT THE ACTIVITY IS A POTENTIALLY DANGEROUS ACTIVITY AND INVOLVES THE RISK OF PERSONAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, TEMPORARY OR PERMANENT DISABILITY, DEATH, PROPERTY DAMAGE, AND/OR FINANCIAL LOSS. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE COMPANY, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE COMPANY. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH AN EXPRESS UNDERSTANDING OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN] THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE COMPANY OR OTHERWISE. BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY. I ACKNOWLEDGE THAT PRIOR TO SIGNING THIS AGREEMENT, I HAD THE OPPORTUNITY TO CONSULT WITH AN ATTORNEY TO REVIEW THIS AGREEMENT. I AM AT LEAST TWENTY-ONE (21) YEARS OF AGE AND FULLY COMPETENT.
